1. WHO ARE WE?

2. WHAT PERSONAL DATA DO WE COLLECT?

Pursuant to Article 4 (1) GDPR, personal data means “any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”

As part of our mission, we are obliged to collect and process personal data. We collect and process only the data that is strictly necessary for the purpose for which it is processed.

  • Data related to candidates for job positions. Depending on the information available on your CV, it can include personal information such as your name, your surname; your contact information such as your telephone number, your e-mail address or postal address; your photo; data relating to your qualifications and your professional experience; any information that you, as a candidate, decide to provide to us while submitting your application or during the selection process.

  • Data related to the provision of our legal services to our clients or data related to our clients’ counterparts or third parties. This can include your identity (for example your name, surname, date of birth, residence); your contact details (for example your telephone number, e-mail address, postal address); your economic, financial and billing information; data relating to criminal convictions and offences, to the extent that its processing is necessary for the proper performance of the professional duties conferred to us or to comply with legal obligations; any other personal data provided to us by you as a client and the processing of which is necessary for the proper performance of the professional duties assigned to us or to comply with a legal obligation to which the Firm is subject.

  • Data that you decide to share with us when you decide to contact us, for example, your identity, your contact information and the content of your request and any related information.

  • Data of companies providing services to us, where you are providing goods or services to us. This can include your identity information; your contact details; information on the services or products provided; your billing and financial information; any other personal data provided to us by the supplier.

  • We do not collect any sensitive data, except if doing so is required by legal or regulatory provisions, for the exercise of the mandate you entrusted to us or if your voluntarily shared the information with us. In the case of special categories of personal data, the data will be obtained and processed in strict compliance with Article 9 GDPR.

3. HOW DO WE COLLECT YOUR DATA?

We can collect your personal data directly from you:
  • when you decide to share it with us, for example when you contact us, when you apply for a job in our Firm
  • when using our legal services, where the collection and processing personal data is necessary for the execution of our mission and the fulfilment of our mandate.

We can collect your personal data from third parties, in the context of our legal obligations or in carrying out the mandate you have entrusted to us. This can include administrative authorities, jurisdictions or regulatory bodies.

When we collect personal data directly from you it is your decision whether to provide data. If you decide to not provide the data, it may hinder the provision of the services, activities or actions you have requested from us.

We need to collect and process your personal data only for specific purposes:

  • The performance of our professional duties and the fulfilment of our professional mandate
  • The selection of candidates applying to professional positions in our Firm
  • The management of your relationship with us
  • The management of your request when you decide to contact us
  • The administration of the firm
  • The compliance with legal and regulatory obligations to which we are subject
  • To establish, exercise or defend legal claims

5. ON WHAT LEGAL BASIS DO WE PROCESS YOUR DATA?

The legal basis on which the processing of your personal data is based are:

  • processing of your data is necessary for the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract;
  • the processing is necessary for compliance with a legal obligation to which we are subject;

6. HOW LONG DO WE RETAIN YOUR DATA?

7. WITH WHOM CAN WE SHARE YOUR DATA?

We are lawyers and, as such, we are subject to a professional deontology that implies a substantial limitation to the disclosure to third parties of the personal data of our clients.

As a general rule, we will not transfer your personal data to countries outside the European Economic Area, which includes, in addition to the Member States of the European Union, Norway, Lichtenstein and Iceland. Should such transfers be necessary, they will be made in accordance with the provisions of Articles 44 to 50 GDPR.

8. HOW DO WE PROTECT YOUR PERSONAL DATA?

Your personal data is collected, processed, stored and transferred by using appropriate security measures. We always make sure that your personal data is legally processed only for the purposes described in this Policy.

9. WHAT ARE YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA?

    • Right to restriction of processing: you have the right to obtain the restriction of processing at the conditions stated in article 18 GDPR.

    • Right to data portability: where the processing is based on your consent, a contract, or automated means, you have the right to receive the personal data you have provided in a structured, commonly used and machine-readable format. Where technically feasible, you can request the secure transmission of your personal data to another data controller (Art.20 GDPR).

    • Right to object to data processing: you have the right to object, at any time, on grounds relating to your particular situation, to the processing of your personal data by indicating the reasons relating to your particular situation. In any case, your right to object to the processing of personal data for direct marketing purposes is absolute and can be exercised at any time (Art. 21 GDPR).

    • Right to withdraw your consent: where the processing is based on consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

  • Lodging a complaint
